Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hub4Creators platform and all associated services (collectively, the "Service"), operated by Hub4Creators ("we," "us," or "our"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age, or such higher minimum age as required by the laws of your jurisdiction, to use the Service. By using the Service you represent and warrant that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

You must provide accurate and complete information when creating an account and keep that information current. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@hub4creators.com if you suspect unauthorized access to your account.

3. Description of Services

Hub4Creators provides tools that allow users to manage custom domain redirects, track link analytics, host branded email addresses, and grant team members authorized access to their account. Specific features available to you depend on the subscription plan you have purchased. We reserve the right to modify, add, or remove features at any time.

4. Subscriptions, Billing, and Cancellation

The Service is offered on a recurring subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis at the interval associated with your plan. All fees are stated at the time of purchase and are charged in advance.

Depending on your usage, additional charges may apply beyond the amounts included in your subscription. You will be notified of any applicable overage terms at or before the time of purchase.

All fees are non-refundable. You may cancel your subscription at any time through your account settings, and you will retain access to the Service through the end of your current billing period. Cancellation prevents future charges but does not entitle you to a refund for any period already paid.

We reserve the right to change pricing upon notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to:

6. Email Services

Where the Service provides hosted email functionality, you are solely responsible for ensuring that all email sent through your account complies with applicable law, including without limitation the CAN-SPAM Act, GDPR, and any other anti-spam or data protection regulations applicable in your jurisdiction. You may not use Hub4Creators email infrastructure to send unsolicited bulk email or to engage in any activity that would constitute abuse of email systems.

7. Authorized Team Members

If your subscription permits you to grant other users access to your account, you remain fully responsible for all actions taken by those users under your account. You must ensure that any users you authorize comply with these Terms.

8. Intellectual Property

You retain all ownership rights in the content you create and manage through the Service. By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely as necessary to provide the Service to you.

Hub4Creators retains all rights, title, and interest in and to the Service, including all underlying software, designs, and technology. Nothing in these Terms transfers any ownership of our intellectual property to you.

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and we will not be liable to you or any third party for any such modification, suspension, or discontinuation.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HUB4CREATORS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR SERVICE INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO HUB4CREATORS IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hub4Creators and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content or activity conducted through your account.

13. Termination

You may terminate your account at any time by canceling your subscription and ceasing use of the Service. We may suspend or terminate your access to the Service immediately and without prior notice if we determine, in our sole discretion, that you have violated these Terms or that your use of the Service poses a risk to us, other users, or third parties.

Upon termination, your right to access the Service ceases immediately. We may retain or delete your data in accordance with our Privacy Policy and applicable law.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Connecticut, and you consent to personal jurisdiction in those courts.

If you are accessing the Service from outside the United States, you are responsible for compliance with any local laws applicable to your use of the Service.

15. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the Effective Date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
